This is just a question, so don't read anything derogatory into it please. Do you (Ohio Club I guess) have to get permission from the people in the picture, before you can go and make money off of them.? Like Viper Exchange/Tomball Dodge, or Riley etc.?

    Thanks

Appreciate the question and your concerns.Viper Exchange just ordered 21 of the banners to distribute to their sponsors, so I guess they approved it!

That doesn't answer my question Sam. I was just curious (not concerned) if permission was needed to make money off of others images. I actually shut a seller down on Ebay about 2 years ago that was selling posters of my Aero Coupe without my permission and was just curious.

    Thanks

There are different laws and rules that apply depending on where the car is at the time a picture is taken, public or private venue, and what the person is using the image for. Consult an attorney or Google the topic for more info. I can't speak to your general question about money off of others images being the only factor involved. In this case the photographer "donated" the pictures to the project. The image in the photos, that you ask about, belongs to the car owner, as you said in your post above.

If we were selling these on ebay there could be an issue. The fact is that we sell our stuff on the VOA site or at our local events to benefit the VOA and/or charities. This project's profits are split between Ohio and PA/WV( photographer) VOA regions. All the parties involved in this project are aware of what we are doing and as I said in my previous post, the race team owner purchased 21 of these to distribute to the race team sponsors.

Unless an image is used in a derogatory manner most "sponsors" on cars or other media seldom object to incidental images of their logos that become part of a photograph. Remember why they paid to have their names on the car to begin with! The fact that people are buying an image that perpetuates the fleeting image of a race car theoretically forever, is just an added bonus to that advertiser.

We are gearing up for our annual party in a couple months and will have some brand new helmets, signed by the drivers, a table from a wheel from last years GTLM car, signed by drivers, gas pump, traffic light and many more items. Expect a new thread soon to start promoting our Ohio party and live online auction.
