    Help!! Need Advice on Dealership

    Some may remember me from the thread I posted regarding a dealership here in Vegas that was holding my Viper in service for weeks: http://driveviper.com/forums/threads/10140-Enraged!!!

    That very same dealership has abruptly demanded an additional $14k down (non-refundable) to continue with the building of the 2016 ACR I put in an order for about two weeks ago. The only excuse I got was that "upper management" has demanded an additional deposit since the car was so "rare". Up to that point, there was indication of any issues and the sales manager happily took my build info on the ACR (which was a fairly common build combination), had me sign a sales order which actually includes the originally agreed upon cash deposit and includes not only my signature but also the signature of the a manager at the dealership. I also have the receipt for the dash deposit I originally gave them.

    They are refusing to release my deposit and issue me a refund unless I meet certain conditions, including having a bank statement with proof of the deposit amount coming out of my bank account. They want this statement to be stamped by someone at my bank. However, the manager at my local branch informed me that actually don't have a stamp and can't meet this required demand.

    This is the same dealership whose service department has held my 2014 Viper in service for nearly 2 months over the last 4 months. They are the dealership that hit my car bumper with another car while it was in service. They are the same dealership that promised me such things as additional cash off a new purchase, tint job on a new purchase and clear protectant sealant on a new purchased vehicle. All of which was fine as I had a deal established and agreed upon with the sales rep and sales manager of the dealership.

    Now, I have a car that i've had to pay to be in service for 2 months that I didn't have it and which has a front bumper that I can only hope I won't have any problems with in the future. I'm missing money out of my account because this dealership is holding my deposit while demanding "proof" that I don't legally have to supply them with and apparently can't even if I wanted to. And I no longer have a deal for a new 2016 ACR, a deal I had been working at for the last two months +. My attorney is suggesting I take legal action against them immediately and I am thinking that over. I just wanted to hear what others think and if others have had any similar things happen to them and could offer any suggestions. Thank you!

    Man, I have no idea why you stuck with them after the service fiasco.

    Is your current deposit refundable? If so, get it and find another dealer. Even if not, I wouldn't expect them demanding more cash up front and you deciding to walk to hold up in any court of law as acceptable.

    You really need to stop doing business with this dealership and work with your attorney at this point.

    This is unbelievable. I would say follow your attorney's advice, you may have to sue. Also, call Bill P at Woodhouse and order the ACR your want, the way you want it. Bill will get it done for you. Good luck!

    Also, I have been advised by my attorney that legally the dealership cannot cancel the sales order or demand additional deposit because I have this signed receipt. I only cancelled it because I had had about all I could take from this dealership although now that they are holding my initial deposit, I might demand that they honor the initial and signed agreement and continue on with the build. Even though I have an awesome attorney i'm not sure I want the hassle in my life right now.

    Benefit of doubt. That's what I gave them, which in hindsight was a mistake. I'd really like to cut my losses here and move on but I don't want to get involved with another dealer until this matter is cleared up and resolved to my satisfaction.

    Never ever buy any Viper new from any dealership other than those mentioned here. Bill P is the best!!!

    I'm really bummed to read this. Unless you signed a binding contract, your deposit can not be held by the dealership.

    Im sorry to hear that you are having such trouble with this dealership, I would have never dealt with them after the way they treated you with your first Viper. Find a way to cut rope and run! Get your self a lawyer if need be.

    Go with your attorney's advice and hope that a letter from your attorney demanding your deposit back is enough to make them cough up the money. Why you went with them after what they did to your Viper is beyond me. Hopefully, you get your deposit back and can move on from this.

    Should've done thorough thinking before placing that order with them. Sue them.

    The other real question is where are all of these lawyers who said that you could work it out with this dealership before? Remember them? I seem to remember tons of accusations saying that taking a hard line with the dealership was foolish. I seem to recall only one person saying to take a hard line. Wonder who that could have been?

    I commented before that this dealership was unethical and that you should not be treated this way because you "had money". You paid good money for a car and it was significantly damaged. You were a good guy about it. Now, this dealership is going to make their money back on you, one way or another. Again, unethical, while you were willing to let the issue slide and move on.

    As for the resolution........look, you most likely signed something about purchasing the car. Read it. They may be trying to change the terms on you. If they are trying to change the terms, hold them to the contract if you can. Otherwise you are going to have to be more nasty with them. They do not treat you as a valued customer.

    Even if you had a new car delivered, who knows what they will do to it. Hope you get out of this set of problems.

    Before paying an attorney can somebody (dealership sponsor) make a call for him (ie dodge corporate)? In return OP can work with that sponsoring dealer on the ACR purchase?

    i would go HAM on these cats at the dealership asap. How you didn't get money out of them when they held your viper for 2 months on an issues they caused is beyond me. Situations like this fire me up.

    I'm no expert, but if they took your deposit, that was their acceptance of a contract to provide the ordered car, if they won't hold up their end, and order the car for that amount, they have broken the contract, and should give you your deposit back no questions asked. They know they took your money, there is no need for you to prove this to them..... WTF?

    If it's the dealer here in Vegas I think it is, they don't treat anyone as a "valued customer."

    Exactly!! My friend is the GSM of a big Chevy dealer and told me the same thing. They cannot hold or take-not refund your deposit until you sign the papers. They would have no problem selling that ACR you ordered.

    A great and humble Thank You to everyone who has offered support and advice. And to those who have had nothing nice to say, please let me explain (since reading for comprehension may not be your strong suit) that I was already in negotiations when all the service related issues began. It literally took over 2 months to get my deal worked out and the entire time I was given allowances because of my service related issues...$500 discount here, new tint there, new protective coating or 3M bra...it made for a sweet deal on an ACR that frankly rivaled if not outright beat anything else I saw from other dealers. Why on earth would I pass that up...especially since I had had no issues with that dealership or service department prior (we purchased a truck a few years ago from them also) and I have multiple high end cars, so not having a Viper for a month or two was really no big deal in that regards. Time passed by quickly with the work and other interests I had. It all culminated when they demanded more money for a deposit AFTER a deal had been struck and signed.

    Hope that clarifies things.

    Hi all - I'm not from the LV area so I don't know what dealer orlanderlv is dealing with. I looked through the thread I don't see anywhere the dealer or sales persons name if I could get that might help
