View Full Version : Arrest me RED, Grrrrr!

OK,
Before I get flamed about speeding, I just wanted say that both of the tix were on the freeway and I was just kinda of cruising along in 6th gear, (~ 85 mph...), and the second 1 I got is kinda BS. Got both tix w/in 3 weeks of each other. I paid the fine and took the defensive driving class for the 1st ticket, so no points. Got to wait for a year before I can take the class again, so that is not an option for me on the 2nd ticket. The 2nd ticket also has the WRONG vehicle info on it, none our Viper info is on the ticket.
My main Q's are:
1. Should I try to fight the 2nd ticket because of the wrong vehicle info on it...
2. Just pay the fine on the 2nd ticket, and hope that it doesn't affect my insurance rates on the snake and all of our other vehicles?
Waiting to hear back from a traffic ticket attorney now... My main goal is to keep the 3 points off my license....

You are probably going to get hit a little on your insurance for the first ticket, usually one speeding ticket doesn't add up to much on your insurance.
On the 2nd ticket I'm not so sure I wouldn't just say I wasn't in that vehicle at that time and see what happens. That is unless the attorney says something differently.

A good lawyer will get the ticket thrown out. Keep your record clean.

Contact your local Bar Association & see if they can refer you to an attorney who handles traffic court. If they're like my office, the consultation is free.

thanks for the replies, and I was afraid that was the case.... As long as they have your DL data correct, that was the main thing that will hang me on trying to fight it. I'm more than willing to pay the fine and even court costs, if it keeps the points off my DL.

Not so much.
Fight it.
You could easily beat this ticket based on the incorrect information put down. But if you get a first year lawyer, it will get thrown out immediately, ALWAYS, ALWAYS fight a ticket if you don't want it to get put on your record.

There are many different ways to fight these kind of tickets. Any good traffic lawyer should be able to easily get you out of getting points on your license--but of course the courts will find ways into your pocketbook for that privilege. They will probably have you do a deferred adjudication, aka a plea of no contest, a small fine, ticket free for 90 days, and they will dismiss the citation. Also, even if you do get another ticket within that 90, it means nothing (ticket free implicitly means no convictions, not no tickets). All you have to do is push out the next court date (request reset, request jury trial so that you have another pre-trial date, etc) outside of that 90 day window and you're free n clear.

It all depends on the Judge. If there is any errors on the ticket, what else might be incorrect and then bring into question the officers ability to discharge his duties if you can't even get simple stuff like writing down info correct. In Alabama, that would be enough to toss it.

we have court supervision here in IL. do you? fee is a bit higher, but it goes away after a short period of time. here, you can have court supervision running at the same time in different counties too.

The ticket was from a motorcycle FHP, and the ticket was a printout off some little printer he had on the back of his bike....

Sorry to hear about your tickets. That's a good reminder for me, as I'll find myself going faster than I should sometimes on the highway...Viper or DD.
Just curious, but is the vehicle tag info correct on the second ticket? Makes me wonder if the Trooper fat-fingered the tag number. I can't imagine how he could have the corrrect tag and wrong vehicle info.

Yeah be EXTRA careful if you drive a RED viper, the 1st ticket data was good, it's the second ticket that has the wrong vehicle info on it, all the vehicle info is wrong.

Oh I know, I have a self-imposed ban on drving the "snake" until I get this ticket taken care of. Heck the wife had to drive up to the VOA dinner last Friday night in Daytona! And she had a hard time staying below 80....

In Colorado, they have it pre-plea bargained down to a lesser charge before you even hit the courthouse.
You walk into the courthouse and there is a line to check in. They immediately point you to a little room in the corner and there they present you with a lesser charge, less points and fines if you agree to plead guilty to the much lesser charge. It's like some 3rd world money grab!
BUT having said that, they do present a rather attractive offer and in the end, it is not worth your time and energy to even fight it. Accept it then and there followed up with walk back out of the courthouse to get on with life. Never even see the judge! Sometimes best to just take the lumps, learn from it and move on.

same thing with court supervision here. they know they have you by the balls to get more money out of you, so you just pay the extra money. contrary to what they tell us, its all about revenue.
they have seen all the tricks, they know all the tricks, you arent special, and they are ready for you.
did you speed? yes? then just admit it to yourself, pay the fine, learn from it, and move on to bigger things.

Well if it's against the law to speed why do they sell cars that can go over 200mph?????? It's like saying window tint is illegal but they install it in states where it's illegal, never understood that, even a friend who is a cop did not have the answer....WTF Just outrun them next time....LOL Good luck and keep us posted on the outcome.....

I hear ya, I REALLY don't have the time to go to court, and 1/2 of me just wants to pay the $$ and take the 3 points, (only points on my license ever!) and be done..... But we'll see, need to hear from the lawyer!

Yep, I was speeding and so was everyone else, it's alot easier for the cop to pick out a RED viper than it was the 2 rice burners in front of me... Problem is here in FL, I don't think they have any of those "diversion" programs like they do where you guys live...

Here in PA you can sometime negotiate a zero point ticket.... let them know that you drive for work and you are afraid you may lose your job and would appreciate a zero point ticket..... here it is called a 31-11.... I have had a handful of these.... no points and you still pay the same $120 or so..... so they win by getting their $ and you win by getting no points...... so cops are nice and will allow it before you even get in front of the judge..... some judges may be nice too..... all you have to lose is the small fee for fighting it.....

Well, here is the deal I swung myself, i called the clerk of the courts, and spoke with a customer service rep, and asked to make a court date to ask the traffic judge if he/she would allow me to take the 4 hour defensive driving class, and adjudicate my ticket. She informed me that I could right a letter requesting such. Wrote the letter about 2 weeks ago, got the reply to today, yes I can take the class, (4 hours IN A CLASSROOM, not on-line, $29.99) pay my fine, $129.00. no court costs either! pretty darn happy with the results, even had to tell them in the letter that I was driving a Viper, and not the Honda Passport that was on my ticket by mistake...

I hope so, I just drive around town now... Trying to stay off the hiways! :) It's just really hard to go slow in the car on the hi-ways in 6th gear.... Cop didn't buy that either...

I don't know if they are up in your neck of the woods, but "Ticket Clinic" has a bunch of locations in South Florida, they will usually plead no contest and negotiate a no points fine for you. Cost is under $100 for the lawyer fees plus fine.

When you hire an attorney, typically it will get reduced to defective equipment or a lesser charge and you pay court cost and attorney fee.

Yeah i was talking to a couple of guys at the Miami Boat show about the "Ticket Clinic" deal, but I had already sent my letter to the clerk of the courts....

Thanks Tony, I just have to slow down now!, but it's tough in the snake. I drive 80 -85 mph in my little Kia commutor car, and cops don't even look at me, but in the snake, it get stared at, sitting at stop lights!
